By visiting our website, placing an order, submitting information to us, or using any Membrance service, you agree to be bound by these Terms & Conditions, together with our Privacy Policy and Returns & Refunds Policy.
If you do not agree to these Terms, you should not use this website or place an order with Membrance.
These Terms form a legally binding agreement between you and Membrance Ltd.
We reserve the right to update or amend these Terms at any time by publishing changes on this page.

By using this website or placing an order with Membrance, you confirm that:

You agree not to use our website or services for any unlawful or unauthorised purpose or in breach of any applicable laws.

We reserve the right to refuse service, decline an order, or cancel a transaction at our discretion.
You agree not to copy, reproduce, duplicate, resell, or exploit any part of our website, products, designs, or services without our prior written consent.
All content provided through Membrance is subject to these Terms.
Section 3 – Accuracy of website information
We aim to ensure all information on our website is accurate and up to date. However, we do not guarantee that all content is always complete, current, or error-free.
Product descriptions, pricing, and availability may change without notice.
Section 4 – Changes to services and pricing
Prices for our products may change at any time without notice.
We reserve the right to modify, suspend, or discontinue any part of our service or product offering without prior notice.
We are not liable for any modification, price change, suspension, or withdrawal of a product or service.
Section 5 – Products and services
Membrance provides personalised funeral stationery, including printed and digital products created using information supplied by the customer.
Due to the personalised nature of our products:
all items are made to order
availability may vary
colours may appear differently between screen and print due to screen settings, printing processes, and paper stock
We make every effort to display our products accurately but cannot guarantee exact colour reproduction on every device.
Section 6 – Orders and customer information
You agree to provide complete, accurate, and up-to-date information when placing an order.
This includes:
contact details
billing and delivery information
wording, names, dates, service details
photographs or artwork supplied for design
Membrance is not responsible for delays or errors caused by incorrect information submitted by the customer.
We reserve the right to refuse or cancel any order where information is incomplete, fraudulent, or inaccurate.
Section 7 – Proof approval
Before printing, customers may receive a digital proof for review and approval.
It is your responsibility to carefully review all details, including:
names
spelling
dates
order of service wording
photographs
layout
Once you approve your proof, it is considered final.
Membrance is not responsible for errors that were present in an approved proof.
Any reprints requested after approval may incur additional charges.
Section 8 – Intellectual Property & Ownership of Designs
All designs, artwork, layouts, creative concepts, templates, typography, graphics, product styling, branding, and content created by Membrance remain the exclusive intellectual property of Membrance Ltd.
This includes, but is not limited to:
order of service designs
funeral stationery layouts
bespoke artwork and design compositions
printed and digital proofs
website content
branding, logos, graphics, and product photography
All Membrance designs are protected by copyright and intellectual property laws in the United Kingdom.
Purchase of a Membrance product does not transfer ownership of the design itself or any associated intellectual property rights.
Customers are purchasing a finished personalised product for personal use only.
Without prior written permission from Membrance, you may not:
copy, reproduce, or duplicate any Membrance design
recreate a Membrance design in full or in part
edit, adapt, trace, or modify our designs for reuse
distribute, share, publish, or commercially exploit any design created by Membrance
resell any Membrance design or artwork
use any element of a Membrance design for business, marketing, resale, or commercial purposes
This restriction applies to both the full design and any individual design elements, including layout, decorative details, typography, graphic styling, and composition.
If you wish to reproduce or reuse any Membrance design beyond the original order, you must obtain written permission from Membrance Ltd before doing so.
Membrance reserves all intellectual property rights in all work created by us unless expressly agreed otherwise in writing.
Section 9 – Customer-supplied content
By providing photographs, wording, artwork, or written content to Membrance, you confirm that:
you own the rights to that content; or
you have permission to use and share it with us
You grant Membrance permission to use that content solely for the purpose of designing, producing, and fulfilling your order.
You remain responsible for the accuracy and legality of any material submitted.
Section 10 – Personal information
Your submission of personal information through our website is governed by our Privacy Policy.
Please refer to our Privacy Policy for information on how we collect, store, and process personal data.
Section 11 – Errors and omissions
Occasionally there may be typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, delivery estimates, or website content.
We reserve the right to correct any errors or update information without prior notice, including after an order has been placed.
Section 12 – Prohibited use
You must not use our website:
for unlawful purposes
to infringe intellectual property rights
to upload malicious software or code
to misuse contact forms or website functionality
to interfere with website security or operation
We reserve the right to suspend or terminate access where misuse occurs.
Section 13 – Limitation of liability

This includes, but is not limited to:

customer-submitted errors
courier disruption
colour variation between digital and printed products
Nothing in these Terms excludes liability where it cannot legally be excluded under the laws of England and Wales.
Section 14 – Returns and refunds
Because our products are personalised and made to your specification, we do not accept returns or offer refunds for change of mind.
Refunds or replacements may be offered where items are:
damaged
faulty
incorrect due to an error by Membrance

Section 15 – Order confirmation
After placing your order, you will receive an order confirmation email confirming we have received your order.
Production will begin once all required information has been received and, where applicable, the final proof has been approved.
Section 16 – Delivery
Delivery estimates are provided in good faith but are not guaranteed.
Membrance is not responsible for delays caused by:
courier networks
adverse weather
incorrect delivery details
failed delivery attempts outside our control
Customers are responsible for ensuring delivery information is correct at checkout.
Section 17 – Damaged items
Please inspect your order upon delivery.
If your order arrives damaged or there is a problem with print quality, please contact us within 48 hours of delivery with photographs and your order number.
Where appropriate, we will offer a replacement or refund in accordance with our Returns & Refunds Policy.
Section 18 – Cancellations
Orders may be cancelled only before production has started.
Once a design proof has been approved or printing has begun, your order cannot be cancelled due to the personalised nature of the product.
If you need to request a cancellation, please contact us as soon as possible after placing your order.
Section 19 – Termination
These Terms remain in effect unless terminated by either you or Membrance.
You may stop using our website or services at any time.
We reserve the right to suspend, restrict, or terminate access to our website or services immediately, without notice, if we believe you have breached these Terms or used our website unlawfully or in a way that could harm Membrance, our customers, or our business.
Termination does not affect any rights or obligations that arose before termination, including payment obligations or rights relating to intellectual property, liability, or dispute resolution.
Section 20 – Governing law
These Terms & Conditions are governed by and interpreted in accordance with the laws of England and Wales.
Any disputes relating to these Terms or use of our website shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We reserve the right to update or amend these Terms at any time.
